This year's Hard Rock Calling, the kickoff for Ambassadors Of Rock, taking place on June 27th and 28th, gets off to an insanely strong start with the announcement that, the one, the only, "The Boss", Bruce Springsteen and The E Street Band will be headlining the second day of the two-day festival. Joining Bruce and the gang on Sunday, June 28th, in Hyde Park, will be the immensely talented Dave Matthews Band, bringing the groove to London like it's nobody's business. We appreciate that websites and message boards (“Fan Sites”) have been launched by many fans to share information, experiences, and opinions about our products and services, and we want to encourage that sharing. For this reason, we have developed these Fan Site Guidelines (“Guidelines”) outlining the limited permissible uses of the Hard Rock Materials (Hard Rock name, trademarks, logos, images, photographs, website content, trade dress).
These Guidelines are designed to help you create a Fan Site without having to worry about negotiating a separate agreement with us or talking to our lawyers. If you would like to make any use of our marks that is not covered by this document, you must contact us at [email@example.com] and include a visual mockup of intended use.
Use of Hard Rock Materials on Fan Sites
Our lawyers require us to tell you that Hard Rock Materials are for your personal, non-commercial Fan Site use only. The rights and permissions granted to you in these Guidelines are personal to you, and you may not transfer or assign these rights to any third party. No license is granted or implied by our posting of these Guidelines.
We also reserve the right to revoke this limited use license at any time, for any reason, and at the sole discretion of Hard Rock.
Now that we have satisfied legal, here are the guidelines and policies for use of the Hard Rock Materials:
•Trade Dress and Advertising Elements. Although imitation may be the sincerest form of flattery, you may not imitate Hard Rock's logos, trade dress (overall appearance including stylized font and color scheme), or other elements of Hard Rock product packaging or websites. Such imitation could result in confusion for others about a Fan Site’s affiliation with or sponsorship by Hard Rock, so please do not copy our look and feel.
•Hard Rock Trademarks and Images. You may use Hard Rock's trademarks and copyrighted images only for the purpose of display, identification and discussion of Hard Rock's products and services as expressly permitted in these Guidelines. You may not use Hard Rock trademarks on or in connection with products other than genuine Hard Rock products.
•No Alteration. You must display Hard Rock Materials without alteration (except that you may make proportionate reductions in size as technically necessary to accommodate posting on your Fan Site). Do not modify or alter the Hard Rock Materials in a confusing way, including suggesting sponsorship or endorsement by Hard Rock.
•No Endorsement or Sponsorship. You may not use or display Hard Rock Materials in a manner likely to create the impression that Hard Rock is an official sponsor or author of your Fan Site, or that Hard Rock endorses or has otherwise expressly licensed the Fan Site. Any endorsement or sponsorship must be approved by Hard Rock in a separate agreement.
•Use Trademark and Copyright Notices. All Fan Sites must include the correct copyright and trademark information on each page that contains content related to Hard Rock's property. When referencing specific products or services, the appropriate TM or ® should be used. For example, "HARD ROCK CAFE and its respective logo are trademarks of Hard Rock Cafe International (USA), Inc. in the United States and other Hard Rock entities in other countries. © 2012 Hard Rock Cafe International (USA), Inc. All Rights Reserved."
Additionally, on every page of a Fan Site where Hard Rock Materials appear, you must include the following notice in a font legible to end users of the Fan Site: "[This Website] is not affiliated with, endorsed, sponsored, or specifically approved by Hard Rock Cafe International (USA), Inc. [This Website] may use the trademarks and other intellectual property of Hard Rock Cafe International (USA), Inc., which is permitted under Hard Rock's Fan Site Guidelines [link]. For more information about Hard Rock or any of Hard Rock's trademarks or other intellectual property, please visit Hard Rock’s website at (www.hardrock.com)."
If no Hard Rock Materials are used, please post the some version of the following sentiment: "This site is and unofficial fan site and is not approved by, sponsored by, or affiliated with Hard Rock Cafe International (USA), Inc. For more information about Hard Rock, please visit Hard Rock’s website at (www.hardrock.com)”
•Content from Hard Rock’s Website. You may not make content from Hard Rock websites (audio-visual materials excluded) available through your own site if such use entails Hard Rock hosting such content for you on Hard Rock's website. For example, you may not make available on a Fan Site any content from Hard Rock’s websites in a frame, mirror, Iframe, widget, nor may you link directly to a wallpaper file hosted on Hard Rock’s websites.
•You May Not Change or Manipulate Hard Rock's Audio-visual Materials. You may not download, display, exhibit or otherwise use sound tracks, sound bites, phonorecords, motion pictures, videos, DVD or other streamed moving images (either full-length or clips) from Hard Rock’s websites or other sources that contain such Hard Rock copyrighted materials. Such audio-visual materials often are subject to production and distribution agreements with third parties.
•Merchandise Items Bearing Hard Rock Materials. You may not manufacture, sell, or give away merchandise items such as T-shirts, pins, or mugs that bear any Hard Rock trademarks or include Hard Rock's copyright materials, except pursuant to an express written license agreement from Hard Rock.
No Fee or E-Commerce Activity. Your Fan Site is for your own personal, non-commercial use. You may not charge any fee to customers or visitors to your Fan Site for use of the Hard Rock Materials that you have posted. You may not engage in any e-commerce activities on your Fan Site including, but not limited to, sale of any third party products or services or resale of any Hard Rock products or services. Commercial activity can also include something as simple as providing links to commercial websites or selling advertising (or sponsored links). Any use of sponsored links on sites that include our Hard Rock Materials should be very minimal. You may not make use of the Hard Rock Materials if your site is selling products or services.
•Social Networking Websites. You may use Hard Rock Materials on your personal pages on the social networking sites Facebook® and MySpace®, and other social networking websites that are substantially similar; provided, however that your use remains compliant with these Guidelines and the policies, terms and conditions of those sites. Hard Rock accepts no responsibility whatsoever in connection with or arising from your activities on such sites.
•Use of Non-Public Information Prohibited. You may not publish, display, exhibit or use any information about products or services (including any photographs, text, or drawings of such new products or services or their prototypes) that has not already been released to the general public by Hard Rock.
•Inaccurate, Obscene or Libelous Statements Prohibited. Hard Rock welcomes and encourages honest discussion and opinions about all Hard Rock products on Fan Sites. However, we cannot allow Hard Rock Materials be used on any Fan Site that promotes sexually explicit materials, violence, discrimination or illegal activities, or makes disparaging, libelous or dishonest statements about Hard Rock and/or its products, employees and agents.
In addition to visiting our website, Hard Rock invites you to ask us whatever questions you may have about using the Hard Rock Materials on your Fan Site. Please email Hard Rock’s customer service department at firstname.lastname@example.org. We will do our best to give you timely responses to your questions. Please be aware that there may be some questions that we cannot answer because the information is confidential, trade secret information that Hard Rock cannot release to the public.
What if my Fan Site Doesn't Comply with the Guidelines?
We love to see all the amazingly creative Fan Sites and hope that by clearly communicating the Guidelines for use of Hard Rock Materials, we can avoid misunderstandings regarding use of such materials on your Fan Site. However, if Hard Rock becomes aware of infringing and/or objectionable uses of Hard Rock Materials on your Fan Site, Hard Rock will contact you and/or your Fan Site operator to try to resolve the matter. If we are unable to reach a reasonable resolution, or if we become aware of a pattern of violations of our Guidelines, we may pursue appropriate legal action.
